In response to the Grenfell Tower tragedy, The Building Safety Bill was introduced to tackle shortcomings in the existing building safety regime, on\u00a0April 28th 2022 The Building Safety Act 2022 law was passed.<\/p>\n
The Building Safety Act 2022 has been passed to make homes safer and therefore giving residents and homeowners more rights, powers and protections.\u00a0 The Act is designed will overhaul regulations and simplify the existing system to ensure high standards are continuously met, creating lasting generational change, and setting out a clear pathway on how residential buildings should be constructed, maintained and made safe.<\/p>\n
Importantly the Act has also introduced a number of measures to protect a leaseholder from paying for historic fire safety defects, this is to be known as the Waterfall System.\u00a0 Historically some leaseholders have been left with huge debts due to putting old work right and has left many unable to sell their homes.\u00a0 Leaseholders are now able to undertake backdated legal action,\u00a0 against developers or contractors that have constructed unsafe properties. Duty holders will also have a requirement placed on them to have clear accountability and statutory responsibilities as buildings are designed, constructed and refurbished.<\/p>\n
